As a precondition to granting a certifi cate of compliance for development, the Water Authority (Muswellbrook Shire Council Water and Waste) will, by notice in writing, require the applicant to satisfy a set of conditions. In order to facilitate the said notice, Developers are advised to submit an application for notice of requirements illustrating the nature of anticipated services.

The authority will serve the applicant with a notice of requirements for the due accomplishment by the applicant in order to be eligible to receive a certifi cate of compliance under section 306 of Water Management Act 2000. 

Upon accomplishment of requirements the applicant should inform the Authority, and request for a certifi cate of compliance to be issued.

Muswellbrook Shire Council is the Road Authority for public roads within Muswellbrook Shire, with the exception of freeways and crown land roads. To use the footway for restaurant purposes, an S125 Approval must first be obtained. This advises Council of the proposed use of the footway and allows Council to assess the necessary implementation of conditions relevant to the proposal. These specific conditions need to be identified and adhered to, ensuring Muswellbrook Shire footways are kept safe and well maintained. It is proposed that the maximum level of funding per project will be limited to $2,000 with matching finance from the applicant. Council may consider allocating greater funding if exceptional circumstances can be demonstrated.

Approved projects must be completed prior to March the following year.
